PREAMBLE
From the land of Mesopotamia, where
the dawn of human conscience first emerged and the earliest canons of justice
were enshrined in the Code of Hammurabi;
We, in the Iraqi Liberal Unity
Party (ILU Party), firmly believe that the restoration of Iraq’s grandeur
begins with a return to the sanctity of the law and the upholding of human
dignity.
We hereby establish these Internal
Bylaws to serve as a covenant that consolidates the civil nature of the State
and the authority of its institutions, while liberating the will of the citizen
from the constraints of quotas and external dependency.
Our objective is the construction of
a State of Citizenship—one that does not discriminate among its people, remains
fortified by liberty, and prospers through the rule of law—ensuring that the
unity and sovereignty of Iraq remain the supreme goal above all considerations.
PART ONE: GENERAL PROVISIONS
AND IDENTITY PRINCIPLES
Article (1): Nomenclature The official name in Arabic is "حزب الوحدة الليبرالي العراقي"; the name in English is "Iraqi
Liberal Unity Party"; and it shall be known by the English abbreviation
"ILU Party".
Article (2): Party Identity The "Iraqi Liberal Unity Party (ILU Party)" is a
national, civil, political organization, positioned at the center-right
(Liberal Right). It adopts the liberal approach as a strategic choice for
state-building. The Party shall enjoy legal personality, as well as financial
and administrative independence.
Article (3): Headquarters The temporary general headquarters of the Party is located
in Vanderhoof, British Columbia, Canada, due to the force majeure security
conditions in Iraq. The Political Bureau shall have the authority to relocate
the headquarters to any other location or to open representative and
coordination offices in other countries or within Iraq, whenever the
appropriate political and security conditions are met to ensure the safety of
the members.
Article (4): The Emblem The emblem is designed to include the Party's name in
Arabic calligraphy, incorporating the colors of the Iraqi flag to reflect unity
and citizenship. Below the Arabic design, the phrase "IRAQI LIBERAL
UNITY PARTY" shall be inscribed in a clear, modern font to ensure
international openness and communication.
Article (5): Intellectual Reference The Party adopts the liberal philosophy based on individual
liberty, the social market economy, and the civil nature of the State.
Article (6): Legal Reference and
Compliance The Party is committed to
conducting its political activities through peaceful and democratic means. It
is prohibited from engaging in any activities that violate international laws
or the laws in force in the countries where its general headquarters or
branches are located, ensuring the preservation of its legal personality.
Article (7): Equality The Party rejects discrimination based on religion, sect,
ethnicity, or gender.
Article (8): Independence of
Decision-making The Party is independent in its
decisions and funding from any external or religious entity

TWO: MEMBERSHIP (AFFILIATION, RIGHTS, AND DUTIES)
Article (9): Membership Conditions An applicant for Party membership must satisfy the
following criteria:
- Be
an Iraqi national.
- Have
attained the age of eighteen (18) years.
- Possess
full legal capacity.
- Be
of good conduct and reputation.
Article (10): Affiliation
Application
- A. Applications shall be submitted in writing or
electronically to the Party Secretariat.
- B. The highest levels of digital confidentiality and
encryption shall be adopted for the data of members residing within Iraq
to protect them from prosecution or targeting; their identities may not be
disclosed except upon their personal request or under completely secure
circumstances.
Article (11): Member-in-Training
(Probationary Member) A new member shall remain under
probation for a period of three (3) months before attaining full active
membership status.
Article (12): The Party Oath The oath for attaining membership shall be as follows:
"I swear by Almighty God to be loyal to Iraq and to abide by the
principles of the Iraqi Liberal Unity Party."
Article (13): Right to Vote An active member shall have the right to vote within the
Party’s bodies after six (6) months of affiliation.
Article (14): Right to Candidacy Every member has the right to nominate themselves for
leadership positions in accordance with the specified criteria.
Article (15): Freedom of Opinion Freedom of opinion is guaranteed within the Party, within
the bounds of mutual respect and the public interest.
Article (16): Duty of Commitment Members are obligated to implement the decisions of the
leadership bodies and to defend the Party’s program.
Article (17): Duty of Subscription Members are obligated to pay the prescribed financial
subscriptions regularly.
Article (18): Right of Appeal
(Grievance) A member has the right to object to
any administrative decision concerning them before the authorized committees at
the General Headquarters or branch offices.
Article (19): Conflict of Interest It is prohibited to hold concurrent membership in the Party
and another party or any armed group.
Article (20): Termination of
Membership Membership shall be terminated in
the following instances:
- A. Written resignation.
- B. Death.
- C. Dismissal by a decision of the Political Council.
Article (21): Reinstatement of
Membership Membership may be reinstated by a
decision of the Political Bureau.
PART
THREE: ORGANIZATIONAL STRUCTURE
Article (22): The Cell (Al-Khalia) The Cell is the fundamental unit of the Party. It consists
of two to seven (2–7) members residing within the same residential area.
Article (23): The Local Branch The Local Branch shall oversee the Cells within a city,
neighborhood, district, or sub-district.
Article (24): The Provincial
Coordination Office This is the body responsible for
Party activities and operations within the province (Governorate).
Article (25): Autonomy of Branches Branches shall enjoy administrative autonomy in managing
their local affairs, provided that such management does not conflict with the
Party’s central authority.
Article (26): Periodic Reports Branches are required to submit monthly reports to the
General Secretariat.

FOUR: SUPREME LEADERSHIP BODIES
Article (27): The General Convention The General Convention is the supreme legislative and
decision-making authority within the Party.
Article (28): Convention Timing The General Convention shall convene in the following
instances:
- A.
Periodic Session: The Convention shall meet periodically every three (3)
years (commencing from July 2024).
- B.
Electoral Session: The General Convention must convene at least three (3)
months prior to the expiration of the Party President’s term for the
purpose of electing a President for the new term. In the event of the
incumbent President's re-election, the new term shall commence immediately
upon the conclusion of the previous term.
- C.
Session by Presidential Invitation: The Convention shall convene at any
time upon an official invitation from the Party President, provided that
the agenda and the justifying reasons for the invitation are specified.
- D. In the event that the General Convention cannot be
held due to force majeure circumstances prior to the end of the term, the
President and the Political Bureau shall continue to manage affairs in an
interim capacity for a period not exceeding one (1) year, provided that
the Convention is called as soon as the impediments are removed.
Article (29): Mandates of the
Convention The General Convention shall
exercise the following mandates:
- A. Election of the President.
- B. Amendment of the Internal Bylaws.
- C. Formulation of strategies.
Article (30): Quorum A legal quorum is achieved by the presence of (50% + 1) of
the delegates.
Article (31): The National Council The National Council is the Party’s parliament, composed of
branch heads and elected members. A women's quota of no less than 25% of the
total Council members shall be observed.
Article (32): Mandates of the
Council Monitoring the Political Bureau, approving
the budget, and filling vacancies.
Article (33): The Political Bureau The supreme political leadership, composed of five to
twenty-one (5–21) members. A women's quota of no less than 25% of the total
Bureau members shall be observed.
Article (34): Mandates of the Bureau Making urgent political decisions and crisis management.
Article (35): The General
Secretariat The executive body responsible for
daily activities.
Article (36): The Secretary-General Manages administrative affairs and records minutes of
meetings.
Article (37): Women’s Representation
(Quota) The Party allocates a quota for
women of no less than (25%) of the seats in the National Council, the Political
Bureau, and all leadership bodies, to enhance the principle of equal
opportunity and ensure women's effective participation in party and political
decision-making.
Article (38): Vacancy of Positions Upon the vacancy of the primary official's position in any
Party body, where these Bylaws do not provide for a deputy to replace the head,
the relevant body must be called to convene within a period not exceeding (15
days) from the date of the vacancy. The meeting shall be chaired by the eldest
member, whose task shall be limited to supervising the procedures for selecting
a replacement in accordance with the rules set forth in the Statutes and
Internal Bylaws.
PART
FIVE: THE PRESIDENCY
Article (39): Election of the
President The President shall be elected by
the General Convention through a direct secret ballot.
Article (40): Presidential
Eligibility Requirements A
candidate for the Party Presidency must satisfy the following requirements:
- Be
an active member for at least three (3) years.
- Possess
political competence.
- Be
no less than thirty-five (35) years of age.
- The
tenure requirement stipulated in Clause (A) of this Article shall not
apply to the Party President of the first term (upon establishment).
Article (41): Term of Office The President shall serve a term of five (5) years, which
is renewable.
Article (42): Presidential Powers
and Authorities The Party President shall exercise
the following duties and powers:
- Represent
the Party.
- Preside
over the meetings of the General Body and the Political Bureau and manage
their sessions.
- Propose
the appointment of heads of specialized executive offices and present them
to the competent authority for ratification.
Article (43): Vice President The Vice President shall assist the President and shall
substitute for them in their absence or incapacity.
Article (44): Presidential Vacancy
- A. In the event that the office of the Party President
becomes vacant due to resignation, death, or total incapacity, the Vice President
shall assume the presidency in an interim capacity for a period not
exceeding sixty (60) days, during which an election for a new President
shall be called.
- B. Should the Vice President be unable to assume the
presidential duties for any reason, the Party Secretary-General shall act
in their stead to exercise the same duties for the same duration specified
in the preceding paragraph.
- C. In the event that the Secretary-General is unable to
assume the role, the Political Bureau shall choose an interim President
from among its members via a vote; the candidate who secures a simple
majority of votes shall be assigned the position for a maximum period of
sixty (60) days until elections are held.
PART
SIX: SPECIALIZED OFFICES
Article (45): The Legal Office The Legal Office shall be responsible for drafting
contracts and regulations and providing legal defense for the Party.
Article (46): The Media Office The Media Office shall be responsible for managing the
media apparatus and official platforms.
Article (47): The Accounting Office The Accounting Office shall be responsible for managing
accounts, budgeting, and auditing.
Article (48): The Organizational
Office The Organizational Office shall be
responsible for managing member affairs and horizontal expansion.
Article (49): The International
Relations Office The International Relations Office
shall be responsible for communication with friendly parties and international
organizations.
Article (50): The Studies Office The Studies Office shall be responsible for preparing
economic and political research to serve the Party’s program.
PART
SEVEN: INTERNAL ELECTIONS AND GENERAL CANDIDACY
Article (51): Nature of Balloting
- A. All internal elections shall be conducted by secret
ballot.
- B. Electronic voting via encrypted and secure digital
platforms shall be adopted in the event that the physical presence of
members is not possible due to security or force majeure reasons.
- C. The results of electronic voting shall be considered
legally valid and binding, equivalent to in-person balloting.
Article (52): The Elections
Committee An independent committee shall be
established to oversee the integrity of the voting and counting processes.
PART
EIGHT: FINANCIAL SYSTEM AND TRANSPARENCY
Article (53): Resources The financial resources of the Party shall consist of the
following legitimate sources:
- A. Membership subscriptions, the value and exemptions of
which shall be determined by the National Council.
- B. Unconditional donations and grants accepted by the
Political Bureau, provided they do not conflict with applicable laws.
- C. Returns and profits from activities and events
organized by the Party, as well as investments of its funds in legally
permitted fields.
Article (54): Prohibition of
Conditional Donations The acceptance of any donation
aimed at influencing the independence of the Party is strictly prohibited.
Article (55): Bank Account All funds shall be deposited into an official bank account
in the name of the Party.
Article (56): Financial Disbursement Financial disbursements shall be made exclusively through
the joint signatures of the President and the Head of the Accounting Office.
Article (57): Annual Budget The Party’s fiscal year shall commence on the first day of
January and conclude on the last day of December of each year.
Article (58): Budget Preparation The Accounting Office shall prepare the draft annual budget
in coordination with the General Secretariat; it shall be presented to the
Political Bureau for review and subsequently must be submitted to the National
Council for ratification during its first meeting of the fiscal year.
Article (59): Financial Oversight When necessary, a contract may be established with a
licensed external auditing firm to audit the Party's accounts.
Article (60): Integrity of
Contracting Members of the Political Bureau and
the National Council are prohibited from entering into any commercial or
investment contracts with the Party for personal profit, in order to ensure the
absence of conflicts of interest and to maintain the transparency of the
Party’s financial resources.
PART
NINE: DISCIPLINE AND THE ETHICS COMMITTEE
Article (61): The Ethics and
Discipline Committee An independent committee shall be
established, consisting of five (5) members, with the task of investigating
violations and overseeing the implementation of the professional code of
conduct.
Article (62): Violations A member shall be subject to disciplinary accountability in
the following instances:
- A. Violation of the Party’s Internal Bylaws or its
political program.
- B. Misuse of position or misappropriation of Party funds.
- C. Engaging in conduct that damages the Party’s
reputation or its principles.
Article (63): Disciplinary Penalties The Committee may impose the following penalties:
1.
Notice
(Admonition): For minor violations.
2.
Warning: A formal notice of the violation and its consequences.
3.
Suspension
of Activity: For a period determined by the
Committee.
4.
Dismissal
(Expulsion): To be finalized by a decision of
the Political Bureau upon the Committee’s recommendation.
Article (64): Right to Defense No penalty shall be imposed on any member without a formal
investigation, during which the member is granted the right to present their
defense and evidence.
Article (65): Confidentiality of
Investigations All disciplinary investigation
proceedings are confidential and may not be disclosed except to the competent
leadership bodies.
PART
TEN: DISSOLUTION AND MERGER
Article (66): Dissolution of the
Party The Party may be dissolved in the
following cases:
- A. By a decision issued by the General Convention with a
two-thirds (2/3) majority of the members.
- B. If the reasons for its establishment cease to exist or
if it is impossible for the Party to continue its activities.
Article (67): Merger with Another
Party The Party may merge with another
national party that shares its principles, based on a proposal from the
Political Bureau and the approval of the General Convention by an absolute
majority.
PART
ELEVEN: GENERAL FINAL PROVISIONS
Article (68): Amendment of the
Internal Bylaws The provisions of these Bylaws may
only be amended by a decision of the General Convention, supported by a
two-thirds (2/3) majority of the members present.
Article (69): Implementation of
Decisions All decisions issued by the leadership
bodies shall be binding on all members and sub-organizations from the date of
their issuance or notification.
Article (70): Delegation of
Authority The Party President may delegate
some of his administrative or organizational powers to the Vice President or
the Secretary-General, provided that such delegation is made in writing and for
a specified period.
PART
TWELVE: TRANSITIONAL PROVISIONS
Article (71): Interim Authority The General Convention shall exercise the mandates and
duties of the National Council until such time as the National Council is
formally established.
Article (72): Exceptional Seniority
Requirement Members who join the Party up until
the date of (July 21, 2027) shall be exempted from the party seniority
requirement necessary for candidacy for leadership positions. This exemption
shall apply for one time only during the first electoral term, in order to
ensure the recruitment of competencies during the foundational phase.
Article (73): Foundational
Membership All signatories to the Party's
establishment application, as well as those who join during the foundational
phase, shall be considered active members enjoying full voting and candidacy
rights immediately upon the acceptance of their applications, as an exception
to the time-period requirements stipulated in the Membership chapter.
PART
THIRTEEN: SUPPLEMENTARY FINAL PROVISIONS
Article (74): Code of Ethics The Political Bureau shall issue a "Professional Code
of Conduct" that defines the ethical standards and behavioral rules that
all members must adhere to in their political and social interactions.
Article (75): Administrative
Regulations The General Secretariat shall be
responsible for drafting the detailed administrative and financial regulations
necessary to implement the provisions of these Internal Bylaws, subject to
ratification by the Political Bureau.
Article (76): Effective Date These Bylaws shall enter into force as of the date of their
ratification by the General Convention and shall supersede any previous
internal regulations or instructions that conflict with their provisions.
Article (77): Extraordinary Powers In cases of extreme necessity or existence of a state of
"Force Majeure" that threatens the Party's safety or continuity, the
Party President, in consultation with the Political Bureau, shall have the
authority to issue temporary exceptional decisions. Such decisions must be
presented to the first subsequent General Convention for ratification.
Article (78): Party Seniority Party seniority shall be considered a weighted criterion in
the event of equal competencies among candidates for Party or public offices.
Article (79): Interpretation of
Texts The Party’s Legal Office shall have
the exclusive jurisdiction to interpret the provisions of these Bylaws in the
event of any ambiguity or conflict, and its interpretations shall be considered
legally binding.
Article (80): Archives and
Documentation All Party documents and minutes of
meetings shall be preserved within the General Secretariat. They are considered
"Party Secrets" and may not be disclosed or published except by an
official decision from the competent authorities.
Article (81): Resignation Upon the resignation of the Party President or a member of
the Political Bureau, written justifications must be provided. The resigning
individual shall be granted a period of fifteen (15) days to rescind the
resignation before it is final and accepted.
Article (82): Resolution of Internal
Disputes All disputes between Party members
or its bodies shall be resolved internally through the Ethics and Discipline
Committee. Recourse to the judiciary is not permitted until all intra-party
remedies have been exhausted.
Article (83): Final Approval These Bylaws are considered effective from the date of
their ratification by the General Convention and shall be published on the
Party’s official website.
Article (84): Conclusion These Internal Bylaws represent the foundational pillar for the Party's institutional action, aiming to achieve its political program and serve the national interest. All members pledge to uphold and defend these provisions to ensure the Party's progress and the realization of its goals for a free and democratic Iraq.
CONCLUSION
These Internal Bylaws, with all
their articles and provisions, are not merely static texts for administrative
organization; rather, they represent a living political covenant and a
foundational pillar for a new era of national struggle. Through these Bylaws,
the Party seeks to institutionalize political action and establish a model of
transparency and democracy that reflects the aspirations of our people for a
free and dignified Iraq. We pledge to remain faithful to these principles, and
to ensure that the Party remains a fortress for freedom and a beacon for the
civil state.
